Welcome to the ADRIANAONLINE.COM website (hereinafter referred to as “Adriana Online”, “website”, “us”, “we”). Our website and all of our services are made available to you in accordance with the following Terms & Conditions (starting now “T&C”). By accessing, browsing and shopping on Adriana Online you irrevocably agree that these T&C shall exclusively regulate the relationship between you and us.

We suggest that you read thoroughly these T&C and keep a copy for further reference. From time to time we may update, change and modify this document at our discretion. Kindly check often for updates.

If you do not accept and agree to these T&C you may not use the website and we kindly ask you to leave immediately. Your continued use of the website constitutes your agreement to the T&C applicable at the time of every website use.

ADAM DIGITAL SA is the legal entity you face as your counterpart when accessing, browsing or shopping on Adriana Online.

If you purchase merchandise on Adriana Online, a purchase agreement will be concluded with ADAM DIGITAL SA. Exclusively Swiss material law, under exclusion (i) of the UN Convention on contracts and the international sale of goods, and (ii) of the conflict of law rules, will govern the contractual relationship between you and us as well as these T&C.

1. SHOPPING ON ADRIANAONLINE.COM

1.1 Registration

In order to access certain services on our website you will need to create an account. During the registration process you are required to provide personal information that is true, accurate and complete. Should any of your registration information change, please notify us via our Contact Form Here.

1.2  Eligibility to purchase

This website is available only to individuals who have accepted the Adriana Online T&C. By purchasing products from our website you accept these T&C.

To be entitled to purchase products from our website you will be required to provide your personal data. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. You will also warrant that the payment details are both valid and correct and you confirm that you are the person referred to in the billing information provided. Furthermore, you agree not to impersonate any other person or entity or use a false name or use a name you have not the authority to use.

The credit card registered for the payment must be issued by a Bank acceptable to Adriana Online, whose applications are acceptable by Adriana Online and who have authorized Adriana Online to process a charge or charges on their credit card in the amount of the total purchase price (including, if applicable, sales tax and/or shipping and/or packaging costs) for the merchandise purchased.

To provide our customer the safest shopping experience we adhere to a high-end fraud detection and order screening protocol.

By placing an order on Adriana Online you authorize ADAM DIGITAL SA to perform credit and fraud prevention screening. Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti fraud checks. The screening process will be handled by Riskified (www.riskified.com).

In the event that your transaction does not pass the above screening process, we reserves the right to cancel the order without prior notice or warrant.

1.3  Pre-Orders

Adriana Online may at its discretion grant you the opportunity to pre-purchase items that are to be released to the public in the near future, but which are not yet released at the time you place a pre-order.

A pre-order will be treated in the same way as a regular order, therefore all the provisions of Adriana Online’s T&C shall apply. Accordingly, a pre-order will be processed on the day you have placed it, and all payments will be deducted on that same day.

The delivery dates we indicate when accepting your pre-orders are the dates confirmed to Adriana Online by its suppliers. You acknowledge that these dates are indicative only and that they can be amended or postponed at any time by our suppliers. We are not responsible for delays, cancellations or modifications of all pre-ordered items.

In the eventuality that Adriana Online is not able to deliver a pre-ordered item, we undertake to reimburse the full amount you have paid, with the same payment method you had chosen for the specific pre-order. No interests will be due on the reimbursed amounts.

1.4  Acceptance of the order

By shopping on Adriana Online you implicitly agree to our T&C. All orders we receive are subject to availability and acceptance, we retain the right to refuse any order at any moment.

The offering of merchandise on our website shall not be deemed as a binding offer, it is the invitation to submit a purchase offer, which Adriana Online may decide to accept by sending a purchase confirmation.

After you have completed a purchase on Adriana Online we will send you an email confirming the details of your order and we will provide you with a payment reference and the total value that will be debited from your credit card. This is not an order confirmation and does not imply that Adriana Online has accepted your order, it is just the confirmation that we have received it.

Your order will be accepted and the contract between you and us will be completed only when you receive an email from us notifying you that we have dispatched the products you ordered. This notification shall be deemed as purchase confirmation. We will dispatch the products only upon full payment. Our acceptance of your order will be deemed completed and received by you at the time and date of sending of the e-mail. Time and date are specified on the e-mail. This applies regardless of whether, for reasons outside our control, you have not received that email.

If for whatever reason we may not supply an item you ordered, we will release the funds being held in your account for the purchase.

Risks and benefits regarding the purchased products are transferred from Adriana Online to you at the moment of delivery of the products to the dispatcher for shipping. In other words, you bear the shipping risk.

We may at any time refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our full discretion without any obligation to indicate the reason of the refusal.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards.

Adriana Online may reserve the right to restrict multiple quantities of an item per order or customer, depending on the availability.

1.5  Sizing and Product Details

Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfill an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit.

If you order a product that is priced incorrectly for any reason, we will email or call you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled.

If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

We provide images, descriptions and expected availability of each product. Please use the sizing chart to help you chose the correct size. You acknowledge that the effective sizes may vary depending on the brand and on the product.

We try to display as accurately as possible the colors of our items. However, as display monitors vary, we may not guarantee that the colors are displayed accurately on your display.

1.6  Modifying or Cancelling Your Order

Your order can be modified or cancelled as long as it has not been packed and or shipped. We’ll do our best to accommodate any changes or cancellations before the order enters our shipping queues.

2.  PAYMENT

2.1  Payment security

All transactions submitted on Adrianaonline.com are encrypted with 256-bit SSL technology by our payment provider Braintree (www.braintreepayments.com)  which encrypts information you input and protects it from third parties.

Digital security systems ensure the encrypted transmission of your personal data. Furthermore, Technical measures protect our website against damages, destruction or unauthorized access.

A safe SSL connection (Secure Socket Layer) provides the safe transmission of your personal data, including credit card and account information.

2.2  Payment methods

Adriana Online accepts the following payment methods:

  • American Express
  • PayPal
  • Promotion Code/Coupon (*)

Only one (1) form of payment method may be used on a single order.

You can use the Promotion Code/Coupon at “Checkout” by filling the designated field.
If the order amount exceed the amount from the Coupon, please select the payment method which you wish to cover the remaining amount. If the amount from the Coupon exceed the order amount, you may use the same code for your next purchase. The amount remaining will be available until your credit balance has been used up completely or until the coupon expiration date.

Promotion Codes and Coupons are not valid on sale items and non-cumulative unless otherwise stated by Adriana Online for specific promotional campaigns.

2.3  Prices and Currency

Prices on our website and all transactions - payments, invoice and refunds - are in Euros. All other currencies shown when you place the order are for display purposes only.

As a service to our clients we offer an in-site currency converter in order to approximate the Euro to our client’s local currency from time to time. Final debited amounts may vary according to bank commission fluctuations. We encourage you to contact your local bank and ask them for an accurate currency conversion and bank commissions which may apply at the date and time of your purchase.

The exchange rate is updated twice a day via www.xe.com. 

Our prices are intended net of any sale tax, VAT or any other duty which may be levied in the country of dispatching of the products or in the country of delivery of the merchandise.

2.4  Sales Price Adjastment Policy

If a purchased item goes on sale Adriana Online offers a one-time price adjustment on your order, under the following conditions:

  • Price adjustment requests must be made within fourteen (14) calendar days of your order being placed;
  • The price difference will be refunded to your original method of payment.

If you find an item advertised at a lower price on another online retailer, we will price match your purchase under the following conditions:

  • The online retailer must be an authorized retailer;
  • The same style, size, color, material, and season of the item must be in stock on the retailer’s website at the time of your price match request;
  • The lower price must be advertised at full price The final checkout price, including shipping fees, taxes, and potential duty fees, must be lower than the Adriana Online final checkout price;
  • The lower price must be advertised in the same currency as the price on the Adriana Online website.

If these conditions are met, you may be eligible for a price match.

We are unable to offer price adjustment on items originally purchased in a sale or on any special promotion items that are temporarily reduced in price. Once an item has been purchased at a discounted sale price, no price adjustment will be offered should the item be further marked-down.

3. SHIPMENT AND DELIVERY

3.1  Shipping Countries

Adriana Online currently serves most of countries worldwide. Find Here  if your location is covered by our service.

If you wish to ship outside of these countries or need a special arrangement please contact our Customer Care Team using the Contact Form Here.            

3.2  Shipment Fees, Taxes & Duties

Adriana Online offers free express shipping and duties on all orders. The service is carried exclusively though the DHL network. Detailed terms of service can be found Here.

All shipments that we send are covered by insurance which ceases to exist upon receipt of shipment from the customer.

Deliveries are handled exclusively through DHL Express service with signature confirmation option (POD). This is to insure a safe arrival of your order.

Please be aware that we cannot deliver to post office boxes.

3.3  Delivery Time

All items that are currently available in our warehouse will be shipped within 2 (two) business days from your order. Pre-order items will be shipped as soon as the supplier delivers them to our warehouse.

All orders are process during our main service hours, Monday to Friday, from 9:00 a.m. till 6:00 p.m. GMT+1.

Orders will be ready for dispatch one business day after the receipt of payment, at the latest, unless placed before 11:00 a.m. GMT+1. Orders placed from Friday after 11:00 a.m. GMT+1 to Sunday will be shipped out the next available business day.

The estimated transit time do not account for any potential delays caused by - as an indication but not exhaustive - weather, custom operations, strikes. Furthermore, Adriana Online is not liable for any shipping delays caused by any circumstances beyond its control.

During promotional events (i.e. Christmas, Black Friday, Sales) orders may take up to an additional 48 to be delivered.

You acknowledge and accept that safety and fraud checks for first-time clients may delay shipping.

3.4  Shipment Tracking

Once your order has left us, you will receive a confirmation email containing an air waybill number to track its progress online. If you are a registered customer, you can also follow your delivery by signing into your account and selecting “My Account”, followed by  “My Orders”.

Our shipping partner, DHL, also offers you the flexibility to make changes to your delivery while your order is on its way to you. By changing the service option you agree to our terms and conditions and take full responsibility for any delay, loss or damage that may occur. Any additional cost due to the shipment change required by the customer will be at your own expense.

3.5  Exotic Pelts

Shipments outside of the European Union that contain exotic pelts require an additional document named C.I.T.E.S.

Due to processing time for items containing exotic pelts, delays in shipping may occur. You acknowledge that the custom offices may ask the recipient of a package to provide an import license in order to receive the delivery. You undertake to bear any costs for the process of obtaining the license. These costs are not refunded by Adriana Online.

4. RETURN & EXCHANGE

4.1  Return Policy

Returning or exchanging an item with Adriana Online is extremely easy. If for any reason you need to send back a product you have fifteen (15) calendar days - from the day you have received your order as stated in the POD (Proof Of Delivery) - to submit the exchange or return request.

To guarantee our customers that the products are delivered in perfect condition, Adriana Online performs a four-steps quality check on each product as follow:

  1. All items are checked when received at our warehouse from the designer;
  2. All items are checked during the inventory process before being published on the online catalog;
  3. The items ordered are checked before and during the entire packaging process;
  4. The package is further verified before the shipping.

It is a Customers responsibility to verify products quality upon delivery in a timely manner.

If any defect or damage is discovered it must be reported to Adriana Online not later than 48 hours from the day you have received your order as stated in the POD (Proof Of Delivery) using the Return Form Here.

If no communication is received by Adriana Online within the aforesaid timeframe the Customer confirms that the products received are in perfect condition.

By submitting the return request the Customer accepts Adriana Online’s T&C.

We will collect from your home, work or an alternative address. Be aware we can only accept returns from the country to which an order was originally shipped otherwise, the return is unfortunately not free of charge (import and shipping fees will be charged at your own expense).

Adriana Online offers free shipping and duties on all returns within then EU and United States. Orders returned from any other areas are subject to €. 15.00 return fee.

4.1.1  Repeted Returns

Adriana Online offers a flexible returns policy. We do monitor the number of returns made by the customers, and continued returns will be flagged and may – at our discretion – lead to the closure of your Adriana Online account or future order being refused.

4.1.2  Late Returns

Return requests submitted outside the fifteen (15) calendar days - from the day you have received your order as stated in the POD (Proof Of Delivery) -  are not eligible for refund unless or eventually accepted at discretion of Adriana Online.

4.2  How to submit a return or exchange request

Before you submit a return request we strongly recommend to carefully review the Return Guideline Here.

Should you need to return or exchange your purchase, you have fifteen (15) calendar days - from the day you have received your order as stated in the POD (Proof Of Delivery).

All return requests are processed during our main service hours, Monday to Friday, from 9:00 a.m. till 6:00 p.m. GMT+1.

To ensure traceability and prompt management of the return procedure, the request must be submitted using the Return Form Here.

4.2.1  Return Condition

  • All items must be returned in their original condition, without having been worn, washed or altered in any way (Indicative but non-exhaustive list of alteration meaning: stains, marks, perfumes, unpleasant scents, scratches, cuts, holes, pulled threads, excessive folding and crumpling);
  • The SECURITY TAGS, Designers Tags and any other tags must not be removed, damaged or tampered;
  • Merchandise must be returned using all original packages both internal (signature box) and external. We reserve the right to refuse multiple returns from one order sent at different times;
  • Return shipments must be made using the DHL service and return labels provided by Adriana Online.

4.2.2  Exchange Condition

  • We can only exchange non-faulty items that are in their original condition, have not been worn, washed or altered in any way (Indicative but non-exhaustive list of alteration meaning: stains, marks, perfumes, unpleasant scents, scratches, cuts, holes, pulled threads, excessive folding and crumpling);
  • The SECURITY TAGS, Designers Tags and any other tags must not be removed, damaged or tampered;
  • Merchandise must be returned using the original packages both internal (signature box) and external. We reserve the right to refuse multiple returns from one order sent at different times;
  • It is only possible to exchange the same item for a different size; we cannot exchange items for a different colour or a different item altogether;
  • Please be aware that we can only exchange the same item for a different size once;
  • Return shipments must be made using the DHL service and return labels provided by Adriana Online.

4.2.3  Faulty goods

Goods are classified as faulty if they are not of satisfactory quality, fit for purpose or as described. Please note that items which are damaged or as a result of normal wear and tear; by accident; or through misuse will not be considered faulty.

4.3  How to return or exchange your purchase

Once your request is processed by Adriana Online’s Customer Care Team, you will receive a confirmation email containing the prepaid DHL Return Labels and the related shipment documents.

To return the products please follow these simple steps:

  1. Book your pick-up by inserting the DHL AWB number Here; 
  2. Print two copies of the DHL Return Labels and one copy of the Proforma Invoice provided;
  3. Apply on the Shipping Box one copy of the prepaid DHL Return Label;
  4. Give the second DHL Return Label and the Proforma Invoice to DHL representative, by hand, at time of pickup.

You have seven (7) calendar days - from the day from the email is sent - to deliver the parcel in the hands of the courier. If this time frame is not respected, Adriana Online is entitled to cancel your return process and/or refuse the parcel if it were to be returned by other means. This applies regardless of whether, for reasons outside our control, you have not received that email.

5. REFUND

5.1  Refund Policy

Once the return is received at Adriana Online’s warehouse a quality check is performed.

Please note:

  • Only items which meet all the above conditions will be eligible for refund;
  • The refund is always credited to the payment method with which the original purchase was made;
  • The refund is always credited in Euro;
  • The refund is always credited to the purchaser’s account;
  • The time it takes to receive your refund depends on the payment method or your credit card provider;
  • If your purchase was made with a promotional code/coupon, you will receive a refund only for the amount paid that is, the amount charged after the voucher was applied. Furthermore, the promotional voucher will no longer be valid;
  • If the purchase was made with a promotional code/coupon and is returned partially, you will receive a refund proportionately reduced by the value of the voucher.

Adriana Online offers free shipping and duties on all returns within then EU and United States. Orders returned from any other areas are subject to €. 15.00 return fee.

We try our best to accept all returns however if a product is received in an unsuitable condition we have to decline the return; otherwise if we believe that their is a chance for the product to be restored to it’s original condition Adriana Online will offer the possibility of trying to clean the product via a selected laundry service. Adriana Online does not guarantee that the product will be restored to it’s original condition.

The choice to clean the item is made by the customer that will bear all the related costs. The laundry service fee is €. 30.00 and it will be deduct from the total amount of the refund. If you do not provide Adriana Online with any instruction within fifteen (15) calendar days from the day from the email is sent, we will be entitle to dispose finally and irrevocably of the item/s. This applies regardless of whether, for reasons outside of our control, you have not received said email.

Item/s received in an unsuitable condition - or not restored despite the washing – will not be refunded. The item not eligible for refund will be then shipped back to the customer at his costs. If you do not provide Adriana Online with any instruction within fifteen (15) calendar days from the day from the email is sent, we will be entitle to dispose finally and irrevocably of the item/s. This applies regardless of whether, for reasons outside of our control, you have not received said email.

The Customer bears any currency exchange rates risks if do not have an EURO account.

The Customer bears all extra costs occurred by a breach of any of the conditions in these T&C.

5.2  “Final Sale” Policy

All products marked for ‘’Final Sale’’ are NOT eligible for Free Return and are not eligible for refund. If for any reason you are not satisfied with your products they are to be returned at the Customer’s expense via our courier DHL. Once the items are back in our warehouse and only after quality inspection we will issue store credit for the value of the item purchased. Store credit via a voucher can be spent on any product on the Adriana Online website within a three (3) months time period from when you received the voucher.

6. WARRANTY

Adriana Online provides the warranty for defective items according to the provisions of the Swiss Code of Obligations, in particular its par. 192-210. In deviation from these provisions, the rescission of the purchase agreement is excluded and the warranty period is limited to twelve (12) months from the delivery date.

The Code of obligations in English can be found on the official Swiss government website (www.admin.ch).  We encourage you to read carefully the afore-mentioned provisions.

Our liability shall be limited to the value of your purchase order giving rise to a warranty (liability cap).

7. SITE POLICY

The content, the structure and the design of Adrianaonline.com, including these T&C are intellectual property of ADAM DIGITAL SA. You undertake not to violate such intellectual property rights.

We decline any responsibility for the content of third party websites linked to Adrianaonline.com.

8.  SEVERABILITY

If any provision of these T&C is held to be illegal, invalid or unenforceable in whole or in part, then these Terms shall continue to be valid as to the other provisions and the remainder of the affected provision.

9. APPLICABLE LAW AND PLACE OF JURISDICTION

Exclusively Swiss material law, under exclusion (i) of the UN Convention on contracts and the international sale of goods, and (ii) of the conflict of law rules, govern the contractual relationship between you and us as well as these T&C.

For any dispute relating to the application of these T&C (in particular with regard, but not limited to, the purchase of merchandise on Adrianaonline.com), you agree that the ordinary courts in Lugano, Switzerland, will have exclusive jurisdiction. Adriana Online may chose in its sole discretion to proceed before an alternative court.

Lugano will also be the exclusive place of performance and place of execution under these T&C.
